Commercial advertising is an accepted and welcome use of the Internet. However, "spamming" is an unethical and inappropriate method for recruiting prospective clients, advancing a political agenda and/or promoting products and services with email.

"Spamming" is defined as sending unsolicited, commercial advertisements to email users, and/or posting identical USENET news articles to several news groups without permission or request. Transmission of such unwanted solicitations include, but are not limited to:  sending the same or substantially similar email to more than 10 email addresses, blanket email to commercial mailing lists, or broad distribution of so-called "pyramid" or "chain" letters. The universal system of linking electronic mailboxes, via the Internet, is designed for person-to-person correspondence. It was not intended to be used as a broadcast medium.

Just because an email says "this is not spam" or "we do not spam" does not mean that it is not spam. An email asking permission to send email is also unsolicited if it meets the other tests for unsolicited email.

If an individual leaves his/her name and email address at a vendor web page or otherwise expressly invites such a mailing; then, and only then, is communication of a price list, ad representation, sales catalog, or newsletter permitted.  Publishing email addresses on a web page or in a directory is NOT an invitation of commercial email. Absent verifiable evidence of a bona fide request, participation in "spamming" is strictly prohibited.

Any email message is spam if the answer to ANY of the following questions is "Yes":

  • Did this message, or a similar message go to 10 or more different email addresses?
  • Does the email ask the recipient to buy something?
  • Does the email ask the recipient to call a phone number for information, etc.?
  • Does the email ask the recipient to visit a web site?
  • Was the email sent without a request for information from the recipient?
